TIKS Privacy Policy

TIKS s.r.o. (collectively, “TIKS”, “us”, “our” or “we”) provides this Privacy Policy (this “Policy”) to describe the types of information we collect on our website - http://tiks.sk/ (the “Website”) and through any games or mobile applications published by TIKS (the “Apps”), and how we collect, process, store, use, and manage these information, including personal information, and data from users of the Website and the Games (“Users”, “your” or “you”).

Hereinafter, we refer to both the Apps and the Website as the “Services”.

In providing the Services, TIKS s.r.o. acts as data controller, as defined in European Regulation n°2016/679, also known as the General Data Protection Regulation (the “GDPR”).

Please note that the scope of this Policy is limited to information and data collected or received by TIKS through your use of the Services. TIKS is not responsible for the actions of individuals with no relationship to TIKS or third-party companies. Links to those websites available on the Website do not constitute our sponsorship of, or affiliation with, those individuals or companies.

Data Collection

We collect information in either of 2 ways:

When you visit the Website and access the services available we collect:
Contact Information such as your name, email address, the browser settings.
When you post a comment: your email address, name and content of the comment.

When you send us an email:
The content of the email;
Your name and email address.

When you download, install and access our Apps, we automatically collect information about your computing device, including: We may occasionally send you push notifications through our mobile applications to send you game updates, high scores and other service-related notifications that may be of importance to you. You may at any time opt-out from receiving these types of communications by turning them off at the device level through your settings or by going to the settings for the app itself.

* Advertising ID means Apple Identifier for Advertisers (“IDFA”) on Apple and Google Advertising Identity (“GAID”). These are unique identifiers for mobile devices that advertisers use for personalized advertising. They are consistent across all mobile applications and thus allow cross-app tracking.

** Device identifier / information means device type, device model, device maker, device operating system and its language or other technical data like screen size or processor, or combination of this data available from a device for a developer for checking the device compatibility with a particular application.

On Apple, you can opt out of interest based advertising by selecting “limit ad tracking” option in your privacy settings. On Google Android, you can opt out of these ads by choosing “Opt-out of personalized ads”. Advertising IDs are non-permanent, non-personal identifiers, which are uniquely associated with your device. Information received from advertising and analytics partners: Classical Personal Information

We do not collect classical personal information through our Apps (such as you name, address, email or phone number) and you can use our Apps without providing us with your classical personal information. We will receive your classical personal information (such as you name, address, email or phone number) only when you contact us directly and will use such information only to respond to your inquiry.

For the some of our Apps we collect information about the nickname you choose or the information about the name you give to your virtual pet or character. Please do not use your real name.

In-App Purchases

Our Apps enable in-app purchases. We do not process payments for in-app purchases nor have access to your credit card information.

Payment transactions for in-app purchases are completed through the app store via your app store account. Any post-purchase processes are controlled by the app store and are subject to specific terms of such app store. Please review privacy policy and terms of service of your app store.

We use the information we collect and store mainly to provide you with the Services you request from us and to improve your gaming experience and the Website. In addition, we use the information for the following purposes:

Adevertising

We offer our Apps for free or at low cost and in order to do that we need to share information we collect from you with our third party advertising partners that assist us in delivering advertisements to you. When you use our Apps we rely on our legitimate interest to show contextual advertisements to you. Before sharing any information with our advertising partners for the purposes of interest-based advertising, we will always ask for your consent.

When you use our Apps we show contextual advertisements to you. In order to enable advertising we allow our advertising partners to collect advertising identifiers (such as advertising ID on Android and IDFA on iOS) that are considered as personal information under EEA data protection legislations, but they should use it solely for the purposes of contextual advertising. For any other purposes they should use the information solely on anonymized and aggregated basis, this means in a way that cannot be tracked back to your device.

If you have consented to sharing of your personal information for the purposes of interest-based advertising, the advertisements you see are more relevant to you and are based on your app and device usage, online behavior and interests (this is commonly referred to as online behavioral or interest-based advertising). Your privacy is important to us, so we follow not only applicable legislation, but also accepted market practices, such as respecting your privacy preferences on your device. You can choose to opt out of interest-based advertising via "Limit Ad Tracking" on your iOS device or "Opt Out of Interest-Based Ads" on your Android device and all advertising providers are bound to comply with such setting, but we cannot provide any guarantees on their behalf. If you choose to withdraw your consent available via our Apps, we will not share your advertising ID with advertisers for the purposes of interest-based advertising.

Interest-based Advertising

Before sharing any information with our advertising partners for the purposes of interest-based advertising, we will always ask for your consent. Based on your consent we share information we collect from you that can be used to personally identify your device, e.g. persistent identifiers such as advertising ID, IDFA, IP address and other information that may be personal to you with our advertising partners and they can use such data for interest-based advertising. For example they can show you an ad based on your age and gender, they may attach the information gathered from our App to information gathered from other apps, websites, or via other services, and then build profiles, show you an ad based on such profile (for example they might know that device with your advertising ID has clicked on a sports ad within other publisher's app and show to you a sports ad in our App). In addition, we may use and share such information with our advertising partners to target and optimize our advertising and promotions in our and other publisher's apps.

We allow our advertising partners to show interest-based ads to you only if you have consented to the sharing of your personal information for the purposes of interest-based advertising.

You have an option to withdraw your consent to sharing your personal information for the purposes of interest-based advertising at all times. You can withdraw your consent in the app settings, where you can manage your preferences by selecting the option to allow sharing of your personal information for the purposes of interest-based advertising.

When you decide to withdraw your consent or if you do not provide your consent, you may still see the same number of ads on your mobile device; however, these ads may be less relevant because they won't be based on topics you like, your interest, behavior, demographics, etc. Our advertising partners may continue to show you ads based on the content of the application you are using.

Data Retention

We retain your personal data for as long as needed to provide you Services, unless we are required by law to delete or if we accept your request to delete the information. We will also retain and use your personal data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Children's Privacy

We do not knowingly collect or solicit personal data from anyone under the age of 16 or knowingly allow such persons to use our Services.If you are under 16, please do not send any information about yourself to us, including your name, address, telephone number, or email address, without the authorization of your parents. No one under the age of 16 may provide any personal data without such authorization. In the event that we learn that we have collected personal data from a child under the age of 16 without the authorization of the holder of the parental responsibility, we will delete those information as quickly as possible. If you believe that we might have any information from or about a child under the age of 16 without the aforementioned authorization, please contact us.

The data subjects have the right to access, modify, rectify, suppress, delete and, if necessary, and, in specific situation, a right to portability, in accordance with the provisions of the law of 6 January 1978 in its version in force (Loi “informatique et libertés”), and in accordance with regulation n°2016/679 known as the General Data Protection Regulation (GDPR).

In addition, users of our Website or of our Apps understand and acknowledge that in the event of transfer of their data to a third party, the exercise of their rights relating to the transferred data must be exercised directly with the third party concerned.

Data Transfer to Third Party

We cannot provide all services necessary for the successful operation of the Apps by ourselves. We must therefore share collected information with third parties to provide the Services.

Our Apps contain third party tracking and data collection and analytics tools from our service providers. These third parties may use cookies, APIs, and SDKs in our Services to enable them to collect and analyze user and device-related data and information on our behalf. Unity Software and Unity Analytics

Third Party Social Networks

Some of our Apps enable you to connect to third party social networks, to share the content you created within the Apps on such third party social networks or to participate in leader boards or multiplayer apps. If you connect to third party social network, such as Google Play Games Service or Apple Game Center, you will be able to use your account to log in on multiple devices and to synchronize progress across those devices.

Please note, Third Party Social Networks are governed by their own privacy policies, terms and end user agreements and we are not responsible for, and have no control over, the sharing practices or policies of the third parties that operate those sites.

If you use Third Party Social Networks to participate in game related activities, such as in leader boards and multi-player games, you share your information with other players and Third Party Social Networks (for example scores, rankings and achievements).

Some of our Apps can be played in a single or a multiplayer mode. In a multiplayer mode you can play matches with random players. Such Apps will ask you to choose your name. Please do not choose your real name. You can always change your name by going to "Settings" and selecting "Change Name". The name you enter and your rank will be publicly displayed when playing with random players in a multiplayer mode.

Our Apps may contain links to third party websites, products, or services. For example, the Apps may feature offers from third party advertisers or the ability to engage in transactions with such entities. Please note that while using such third party offerings, you are using sites, products, and services developed and administered by people or companies not affiliated with or controlled by us. We cannot control the actions of those people or companies, the content of their sites, products or services, the use of information you provide to them, or any products or services they may offer. Our link to such third parties does not constitute our sponsorship of, or affiliation with, those people or companies. Nor is such linking an endorsement of such third party's privacy or information security policies or practices or their compliance with laws. Information collected by third parties, which may include such things as location information or contact details, is governed by their privacy practices. Cookies may be automatically installed on your browser or your device when you access our Site. A cookie is an element that does not make it possible to identify a person but is used to record information relating to your browsing of our Site.

What cookies may be installed when you visit our Site?

The cookies that may be installed on your browser when you visit the Site are mainly intended to improve the ergonomics of the Site and to enable the use of the services available to visitors such as connecting to the user account or storing the contents of the basket.

How long do cookies last?

There are two types of cookies: session cookies and persistent cookies. Session cookies are created temporarily in the sub-folder of your browser when you visit a website. Once you leave the Site, the session cookie is deleted.
